The petitioner apprehends arrest in connection with Special Case No. 88 of 2016 registered under Sections 20 and 22 of Narcotics Drugs and Psychotropic Substances Act. Learned counsel appearing on behalf of the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. Moreover, the alleged seized ganja was within the small quantity i.e.140 gm.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount

Patna High Court Cr.Misc. No.39932 of 2017 (2) dt.22-09-2017 2/2 each to the satisfaction of the District and Sessions Judge, Patna in connection with Special Case No. 88 of 2016 arising out of Bihta P.S. Case No. 853 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
