JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-09-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Silao Police Station Case No. 171 of 2015, disclosing offences under Sections 147, 148, 149, 353, 332, 337, 427, 504, 506, 171(GA) of the Indian Penal Code. Learned Counsel for the petitioner has submitted that 2 (two) similarly situated persons, namely, Ravi Ranjan Kumar and Krishna Nandan Singh, have been granted anticipatory bail by separate orders passed, on 11.07.2016 and 23.05.2016, in Criminal Misc. No. 28105 of 2016 and 9855 of 2016, respectively.
Learned Counsel appears to be right in her submission that the petitioner's case is identical with the
Patna High Court Cr.Misc. No.36753 of 2016 (2) dt.06-09-2016 2/2 allegations made against the persons, who have been granted anticipatory bail.
Considering the above submission, this application is allowed.
Let the petitioner, Uday Singh, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, at Biharsharif, in connection with Silao Police Station Case No. 171 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
