The petitioner is apprehending his arrest in connection with Brahmapur (K.B.) P.S. Case No. 65/2020 registered for the offence punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.
The allegation, as per First Information Report, is that the petitioner at the time of his appointment on the post of Block Teacher submitted forged and fabricated educational certificates.
Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and before holding his certificates to be forged and fabricated, no inquiry was conducted by the authorities and the
Patna High Court CR. MISC. No.27765 of 2020(6) dt.22-03-2021 2/3 petitioner was also not noticed in this regard. Learned counsel further submits that similarly situated accused person, namely, Jai Ram Singh, whose certificate was also found forged and fabricated, has been granted anticipatory bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 27243/2020. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that similarly situated accused person has been granted anticipatory bail by a Co-ordinate Bench of this Court, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.
20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Brahmapur (K.B.) P.S. Case No.
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the
Patna High Court CR. MISC. No.27765 of 2020(6) dt.22-03-2021 3/3 investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
