JUSTICE PARTHA SARTHY ORAL ORDER 02-12-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Amas P.S Case no. 85 of 2020 registered under section 30(a) of the Bihar Prohibition and Excise Act.

As per allegation in the FIR, a total of 870 litres of country liquor was recovered from a pick-up van of which the petitioner is stated to be the driver.

It is submitted by learned counsel for the petitioner that the allegation of recovery is false and concocted. No incriminating article has been recovered from his possession or from the vehicle. He is in custody since 31.5.2020, the investigation in the case has concluded and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the petitioner being in custody since 31.5.2020 and having no criminal antecedent, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Amas P.S. Case no. 85 of 2020 (G.R no. 705/2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge, Gaya.
