In this case, the petitioner is seeking anticipatory bail in connection with Bihta P.S. Case No.788 of 2017, registered for the offence punishable under Sections 363 and 366(A) of the Indian Penal Code.
Allegation has been made that the petitioner has taken away the daughter of the informant for the purposes of marriage.
The victim girl in her statement recorded under Section 164 of the Cr.P.C. has stated that petitioner has entered into the house in the midnight, threatened her and took away from the house, thereafter she was brought to Gujarat. She also stated that she is married, her mangalsutra has also been sold out by the petitioner.
Patna High Court Cr.Misc. No.26860 of 2018(2) dt.04-05-2018 2/2 Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
