JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-01-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Jogapatti P.S. Case No. 257 of 2012, registered for the offence punishable under Section 302, 120B, 504 and 34 of the Indian Penal Code and section 27 of the Arms Act.

Earlier the bail application of petitioner was rejected vide order dated 12.12.2018 with an observation that once charge has been framed in this case, petitioner is at liberty to renew his prayer for bail. Vide order dated 14.12.2021, report was called for regarding the stage of trial and same has been received (kept at flag 'R'), which reveals that charge has been framed on 27.01.2021 and the case is running for prosecution evidence.

Considering the period of custody and stage of trial, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IV, Bettiah, West Champaran in connection with Jogapatti P.S.
