The petitioner apprehends his arrest in Vaishali P.S. case No. 102 of 2014 registered under Section 420, 120B of the IPC.

The informant alleged that he is owner of bus bearing registration No. BR06PA- 3877 but on 29.04.2014 his staff handed over a sale letter sent by Subodh Kumar Singh, the petitioner, in which it was written that bus was sold to petitioner after receiving consideration amount of Rs. 4,90,000/-. The affidavit attached to the sale letter is also false. The informant claimed that he never sworn any affidavit.

The learned counsel for the petitioner submits that the entire allegation is false and concocted. The informant sold the bus and gave sale letter. The petitioner filed Mithanpura P.S.

Patna High Court CR. MISC. No.26471 of 2019(2) dt.24-04-2019 2/2 case No. 357 of 2014 u/s 406, 420 of IPC in which prayer for anticipatory bail of informant was rejected vide order dated 25.01.2017 passed in Cr. Misc. No. 33586 of 2016 and in order to save the skin the informant lodged the present case. Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that petitioner claims that it was the informant who executed sale letter for which he lodged Mithanpura P.S. case No. 357 of 2014, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali P.S. case No.102 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
