2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 379, 307, 448/34 of the IPC.
3. As per prosecution case, while the petitioners were driving the car, they injured the goat of the complainant. On protest, the petitioner no.2 assaulted the complainant and his family members due to which, they sustained injuries. It is further alleged that petitioner no. 1 took away the box of the complainant containing Rs. 5,000/-, a silver chain etc.
4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. The allegations against them are false and concocted. Due
Patna High Court CR. MISC. No.32823 of 2024(2) dt.22-05-2024 2/2 to petty dispute, altercation took place in between the parties, on account of which, both parties have sustained injuries. He further submits that petitioner no. 1 has one criminal antecedent in which he is on bail and petitioner no.2 has got no criminal antecedent.
5. Learned A.P.P for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest or surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each in the satisfaction of learned Court of JM, 1st Class, Jamui in connection with Complaint Case No- 242C/2023, subject to conditions laid down under Section 438(2) of the Code of Criminal Procedure.
