2. The petitioner seeks bail in Sadar P.S. Case No. 608 of 2025 registered for the offences under Sections 319(2), 318(4), 338, 340(2) and 61(2) of BNS and Section 10 of Public Examination Prevention of Unfair Means Act, 2024.

3. The allegation is that the petitioner was caught using blue-tooth device in the examination hall. This adoption of unfair means has caused great trouble to the meritorious students.

4. Learned counsel for the petitioner submits that nothing was recovered from the petitioner in the examination hall but he has falsely been implicated in the case. He further submits that the petitioner is in custody since 11.12.2025 and has no criminal antecedent.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioner.

6. Considering that nothing was recovered from the physical or conscious possession of the petitioner and the petitioner is in custody since 11.12.2025 having no criminal antecedent, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No. 608 of 2025.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
