2. Heard learned counsel for the petitioner and learned A.P.P. for the State.

3. The petitioner seeks regular bail in connection with Saharghat P.S. Case No. 07 of 2022 dated 13.01.2022, lodged under Sections 341, 323, 324, 307, 337, 379, 448, 504, 506/ 34 of the I.P.C.

4. As per the prosecution case, the F.I.R. has been lodged against six named accused persons including the present petitioner alleging that he has assaulted one Rupa Kumari by brick, due to which head injury took place.

5. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He submits

No.29440 of 2023(2) dt.08-06-2023 2/2 that from the contents of the F.I.R., it becomes crystal clear that said scuffling took place due to dispute arisen between the children of both the families. Counsel further submits that for the same date and place of occurrence, there were two criminal cases filed. First case filed from informant's side and second from the petitioner's side bearing Saharghat P.S. Case No. 07 of 2022 and Saharghat P.S. Case No. 08 of 2022 respectively. Counsel further submits that the antecedent of the petitioner is clean and he is in custody since 03.11.2022.

6. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- II, Benipatti, District- Madhubani in connection with Saharghat P.S. Case No. 07 of 2022 dated 13.01.2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

8. With this observation, the bail application stands allowed.
