JUSTICE ANIL KUMAR SINHA ORAL ORDER 07-01-2022 Heard Mr. Anil Kumar, learned counsel for the petitioner and Mr. Ajay Kumar Jha, learned Additional Public Prosecutor appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Mahua P.S. Case No. 495 of 2020 registered for the offences punishable under Section 420 and 468/34 of the Indian Penal Code 1860.

As per prosecution case, the nephew of the informant has sold a piece of land belonging to the informant in favour of wife of the petitioner namely, Manju Devi.

Learned counsel for the petitioner submits that the wife of the petitioner is a bona fide purchaser of a piece of land and partition between the informant and his brother has already been taken place, which would be evident from the First

Patna High Court CR. MISC. No.37670 of 2021(2) dt.07-01-2022 2/2 Information Report itself. Learned counsel further submits that the sale deed executed in the name of petitioner's wife has been challenged in a Title Suit bearing Title Suit No. 489/20. The petitioner is in custody since 12.4.2021.

Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that the petitioner is in custody since 12.4.2021 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahua P.S. Case No. 495 of 2020. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
