JUSTICE SUDHIR SINGH ORAL ORDER 13-01-2017 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant. The petitioners are apprehending their arrest in a case registered under Sections 354(A), 354(b) of the Indian Penal Code and Section 12 of the POCSO Act, 2012.

Allegation is that the petitioners told unparliamentary language to the informant and tried to snatch dupatti and when she cried they fled away.

It has been submitted on behalf of the petitioners that there is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The witnesses examined in paragraph nos.21 and 22 of the case diary have not supported the allegations made in the

Patna High Court Cr.Misc. No.41490 of 2016 (5) dt.13-01-2017 2/2 F.I.R.

On behalf of the State and the learned counsel for the informant, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Kudra P.S. case No.201 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
