Mr.Ajit Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 06-05-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in POCSO Case No. 17/2018, arising out of Parbatta P.S. Case No. 222/2018, G.R. No. 1672/2018, instituted for offences under Section(s) 451, 376, 379 of the Indian Penal Code read with Section 12 of POCSO Act.

Learned counsel for the petitioner has submitted that earlier also informant had lodged a case bearing Parbatta P.S. Case No. 30/2017 against the petitioner, in which he is on bail. It is further submitted that petitioner has been implicated in this case because of land dispute. Petitioner has voluntarily surrendered on 26.02.2019. There is no medical evidence with regard to committing rape with the informant.

Petitioner is in custody since 26.02.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ 1st-cumSpecial Judge, POCSO, Khagaria, in connection with POCSO Case No. 17/2018, arising out of Parbatta P.S. Case No. 222/2018, G.R. No. 1672/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
