JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-05-2018 The petitioner seeks bail in anticipation of his arrest in connection with Warisnagar P.S. Case No. 136 of 2017 dated 04.06.2017 instituted for the offences under Sections 447, 341, 323, 354, 354(B), 379, 504 of the Indian Penal Code. The petitioner is alleged to have misbehaved with the wife of the informant and has also indulged in assaulting the informant and others.

The learned counsel for the petitioner has submitted that in fact the dispute was with respect to plucking of lichi fruits. The petitioner as well as the informant are neighbours and the present case has been lodged after an inordinate delay of about a month of the occurrence.

The petitioner does not have any criminal antecedent.

No.25657 of 2018 (2) dt.04-05-2018 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Warisnagar P.S. Case No. 136 of 2017.
