====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 23-04-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Excise Case No. 166 of 2019 corresponding to Excise P.R. Case No. 13 of 2018, instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Amendment Act, 2018.
It is alleged in the written report that 6.300 litres of foreign liquor has been recovered from Plastic bag kept beneath the seat in a bus. Police seized the aforesaid liquor and prepared seizure list.
Counsel for the petitioner submits that petitioner was passenger in the bus. He has no concern with the aforesaid illicit liquor. Police has taken signature of the petitioner on the
Patna High Court CR. MISC. No.25147 of 2019(2) dt.23-04-2019 2/2 seizure list. Counsel for the petitioner further submits that petitioner has clean antecedent. He is in custody since 4.3.2019.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 4th cum Special Judge, Kaimur (Bhabua), in connection with Excise Case No. 166 of 2019 corresponding to Excise P.R.
