Petitioner apprehends his arrest in a case filed under Sections 147, 148, 149, 341, 323, 307, 354 and 379 of the Indian Penal Code and Section 27 of the Arms Act. It is contended on behalf of the petitioner that there is land dispute between the parties which would be apparent from the Annexure 2 which is a letter issued by the D.C.L..R., Hajipur addressed to the Circle Officer, Bidupur on the complaint of Geeta Devi stating that the petitioner in the concerned ceiling case is trying to forcibly harvest her crop. It is stated that it was the reason for lodging a criminal case by Aditishri, the daughter of the informant, Renu Devi under Section 354 of the I.P.C. in which

No.1165 of 2016 (2) dt.15-01-2016 2 / 2 the anticipatory bail was granted to the petitioner and, thereafter, this time Reun Devi, i.e., the mother of the Aditishree, has made allegations against him under Section 354 by giving a bald statement. It is surprising that such allegation is being made against the petitioner that in the presence of his mother Geeta Devi and 4-5 persons, such occurrence has taken place. Having regards to the facts and circumstances, in the event of arrest/surrender within a period of six weeks from today in Bidupur P.S. Case No.357/2015, the above named petitioner, Manish Ram @ Manish Kumar shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of C.J.M., Vaishali at Hajipur subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
