JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Marhaura (Madhaure) P.S. Case No.352 of 2020 for offences under Section 304 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent. Learned counsel submits that the petitioner is a farmer and bonafide electric consumer. He has installed a pump-set for the purpose of irrigation of his field. It appears that due to short-circuit, electric current passed through the fence of the field. The father of the informant came in contact with the electric current and died to that reason.

Let petitioner, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Saran at Chapra in connection with Marhaura (Madhaure) P.S. Case No.352 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anil Kumar Upadhyay, J) BT/- U T
