2. The petitioner apprehends his arrest in connection with Maheshkunth P.S. Case No. 198 of 2023 registered for the offence under Section 188, 420, 467, 468, 471/34 of the Indian Penal Code and under Sections 30(a), 32(i) (ii), 41 of the Bihar Prohibition and Excise Amendment Act, 2022.

3. As per the prosecution case, there is recovery of 3438 liters of illegal foreign liquor.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he is named in the confessional statement of the other co-accused Lakhwinder Singh and nothing has been recovered from his possession.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge-II, Khagaria/concerned Court below in connection with Maheshkunt P.S. Case No. 198 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.

7. This is also subject to the condition that the petitioner shall deposit an amount of Rs. 45,000/- (Rupees Forty Five Thousand Only) in Ramakrishna Mission Ashram, Nala Road, Patna and produce the receipt of the same before the Court below. The bail bonds of the petitioner shall be accepted after verifying the genuineness of the receipt produced by the petitioner.
