JUSTICE SHIVAJI PANDEY ORAL ORDER 21-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.

In the present case, prayer has been made on behalf of the petitioner that he should be treated to have been appointed and be given seniority from the date the other persons were appointed against the advertisement No.1 of 1998. The petitioner was not appointed at the initial stage, with grievance he approached this Court in C.W.J.C. No.1247 of 2008 and ultimately, the respondents have given appointment to the petitioner but the respondents have treated the petitioner to have been appointed from the subsequent date of his appointment. Learned counsel for the petitioner submits that the

Patna High Court CWJC No.3593 of 2013 (5) dt.21-01-2016 2/2 petitioner was not along with others as was wrongly refuted which was later rectified and as such the petitioner should not suffer prejudice on account of inaction or mal-action of the respondents as such his appointment should be treated along with the other persons who were appointed against the said advertisement. Learned counsel for the petitioner further submits that the petitioner has filed a representation before the Superintendent of Police, Nawada, where he has made request for consideration of grievance concerning his seniority along with the promotion.

As the representation of the petitioner has not been disposed of, the Superintendent of Police, Nawada, is directed to consider the pending representation of the petitioner and pass order in accordance with law within a period of six months from the date of receipt/production of a copy of this order. With the aforesaid observations and directions, this writ petition stands disposed of.
