The petitioners are in custody in connection with Nath Nagar P.S. Case No. 66 of 2019, registered for the offence punishable under Sections 457/380 of the Indian Penal Code and Section 411 and 413 of the Indian Penal Code has been added.

Learned counsel for the petitioner submits that the petitioner No.2 has no criminal antecedent whereas petitioner no.1, is the accused in two cases. Learned counsel for the petitioners further submits that petitioners were not named in the F.I.R. Learned counsel for the petitioners would next

Patna High Court CR. MISC. No.26681 of 2019(2) dt.23-04-2019 2/2 contend that nothing was recovered from the possession of the petitioners to connect the petitioners in the crime. Learned counsel for the petitioners submits that petitioners are in custody since 01.02.2019.

Considering the totality of the facts and circumstances as discussed hereinabove, the Court is inclined to grant bail to the petitioners. Let the petitioners named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned Additional Chief Judicial Magistrate, 1st Bhagalpur in connection with Nath Nagar P.S. Case No. 66 of 2019.
