This application for regular bail arises out of Hajipur Sadar P.S. Case No. 150 of 2020, disclosing offence punishable under Sections 364-A/120-B of the Indian Penal Code. A supplementary affidavit has been filed in the present case bringing on record an order dated 20.10.2020, passed in Cr. Misc. No. 22999 of 2020 and Cr. Misc. No. 23010 of 2020 whereby co-accused Himanshu Raj and Anil Kumar Pandey have been allowed regular bail.
On careful perusal of the FIR and the order of this Court dated 20.10.2020, I find substance in submission made on behalf of the petitioner that the petitioner's case cannot be distinguished from the case of those who have been allowed bail by the
Patna High Court CR. MISC. No.24462 of 2020(4) dt.01-12-2020 2/2 aforesaid order.
Considering the above, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in Hajipur Sadar P.S. Case No. 150 of 2020.
It is directed that defects in the application pointed out by the Registry must be removed within two months from today. (Chakradhari Sharan Singh, J) Rajesh/- U T
