2. Learned counsel for the petitioner submits that the truck of the petitioner bearing Registration No.UP42BT4666 has been seized by the District Mining Officer, Buxar. Learned counsel for the petitioner submits that as per Rule 56 of the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation and Storage) Rules, 2019, the respondent No.3 has imposed the fine to a tune of Rs. 2,89,460/- (Rs. Two Lacs Eighty Nine Thousand Four Hundred Sixty) to the petitioner and apart from that, the truck in question is put in the confiscation proceeding by the authority concerned.

3. Learned counsel for the petitioner, on instruction, submits that the petitioner is ready to pay Rs. 2,89,460/- (Rs. Two Lacs Eighty Nine Thousand Four Hundred Sixty) to the respondent No.3 within a period of six months on six equal installments.

4. Learned counsel for the State and learned counsel for the Mines Department have no objection in this regard.

5. In view of the aforesaid, the respondent No.3 is directed to released the ruck in question of the petitioner bearing Registration No.UP42BT4666 in favour of the petitioner after receiving 1st installment from the petitioner and respondent No.3 shall be at liberty to take appropriate action against the petitioner, if the petitioner fails to deposit any installment in accordance with law and when the petitioner will deposit entire amount, the authority concerned is directed to take decision with respect to the confiscation proceeding.

6. With the aforesaid direction/liberty, this writ application stands disposed of.
