Petitioner apprehends his arrest in connection with Muzaffarpur P.S. Case No. 98 of 2016 registered under Sections- 147, 149, 323, 354, 354(B), 498A, 120B, 504, 379, 509 of the Indian Penal Code.

Informant alleged that a Panchayati was held in village Munni where 100 of people besides Punches assembled. In that fuse allegations and abuses were hurled on her. She was disrobed by the petitioner and others. She was made to move in the village in naked position. One of the accused penetrated his finger in her vagina.

Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.53306 of 2016 (3) dt.13-02-2017 2/2 informant is a lady of bad character and her husband and others had objected her for illegal activities, and due to that, she has lodged this false case. Petitioner has no concern with the informant. Specific allegation is against co-accused persons and not against this petitioner.

Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-cum-Sub Judge 7th, Muzaffarpur in connection with Muzaffarpur Mahila P.S. Case No. 98 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Arvind Srivastava, J) Manish/- U T
