Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner has antecedent of three cases and allegation is of recovery of 150 litres of liquor from two motorcycles as detailed in the FIR.

Learned counsel for the petitioner submits that petitioner was not apprehended from the spot and is neither the driver nor the owner of the seized vehicle. It is next submitted that he came to be implicated at the instance of local people and

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the submission made by learned counsel for the petitioner and the period of incarceration, let the petitioner above named be released on bail on furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Shahpur Patori P.S.
