2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 274, 275 of the Bharatiya Nyaya Sanhita and Sections 30(a), 41 of the Bihar Prohibition and Excise Act.
3. As per prosecution case, 6.90 litres foreign liquor was recovered from sack allegedly thrown by this petitioner.
4. Learned counsel for the petitioner submits that sack in question does not belong to the petitioner. No incriminating material has been recovered from conscious possession of the petitioner and he has been made accused only on suspicion. Petitioner claims clean antecedent.
5. Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that
Patna High Court CR. MISC. No.26970 of 2025(2) dt.06-05-2025 2/2 let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Court No. 1, East Champaran, Motihari in connection with Banjariya P.
