Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Excise Case No. 09 of 2012 registered for the offence punishable under Section 47(a) of Excise Act.

Taking into consideration that seizure of illicit liquor was made from the shop of the petitioner in the year 2012 and he knocked the door of Sessions Judge for grant of anticipatory bail in the year 2016 i.e. after four years of the alleged occurrence, I am not inclined to extend the privilege of anticipatory bail to

Patna High Court Cr.Misc. No.42010 of 2016 (5) dt.22-11-2016 2/2 petitioner and accordingly, his prayer for anticipatory bail in connection with Excise Case No. 09 of 2012 pending in the court of Shri A. Mishra Judicial Magistrate, Raxaul at Motihari, East Champaran stands rejected.
