JUSTICE RAKESH KUMAR ORAL ORDER 17-10-2017 Heard Sri Randhir Kumar No.1, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Dalsingsarai P.S. Case no.87/2017 registered for the offence under Sections 30(a), 38(I)(II) of the Bihar Excise (Amendment) Act,2016, has prayed for grant of bail, in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that save and except confessional statement of the co-accused, there is no material to connect the petitioner and the petitioner is having clean antecedent, which fact has been mentioned in paragraph-3 of the petition.

Considering the nature of accusation, clean antecedent as well as the fact that the petitioner's name has come on the basis of confessional statement of the co-accused, let the petitioner,

Patna High Court Cr.Misc. No.49442 of 2017(2) dt.17-10-2017 2/2 namely, Raj Kumar Singh @ Raja Singh, in the event of his arrest or surrender within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand)with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge VI, Samastipur in connection with Dalsingsarai P.S. Case No.87/2017, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
