The petitioner apprehends his arrest in connection with Mairwa P.S. Case No. 90 of 2016 registered under Sections 452, 354, 379 and 448 of the Indian Penal Code. The allegation of informant is that her husband had gone to supply electric through Generator to the house of petitioner on 10.04.2014 in the evening. In the meantime, petitioner entered at the house of the informant when the informant was sleeping at her house along with her children and tried to commit rape by unfolding her cloths but she raised alarm then petitioner snatched cash Rs. 30,000/- which was kept by the informant in her blouse.
Patna High Court Cr.Misc. No.44397 of 2016 (2) dt.22-10-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that petitioner and informant are co-villagers and due to election rivalry with the petitioner and husband of the informant, husband of the informant got managed and lodged this false case by his wife.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Siwan in connection with Mairwa P.S. Case No. 90 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
