JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 11-10-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State as also the learned counsel for the informant. The petitioners apprehend their arrest in connection with Jehanabad P.S. Case No.538 of 2016 registered under Sections 147, 148, 149, 341, 323, 307 and 385 of the Indian Penal Code. The accusation is that while the informant was constructing his house, at that time, seven persons, named in the F.I.R., including the petitioners alongwith 5-6 unknown came their and started to abuse. At that time, the petitioner no.1 Guddu Singh
Patna High Court Cr.Misc. No.47623 of 2017 (2) dt.11-10-2017 2/3 asked the informant as to why he has not given Rs.50,000/-, as demanded by him, as ransom. In that course, the petitioner no.1 Guddu Singh caused assault to the informant on his head through iron rod. The petitioner no.5 Shashi Bhushan Singh and the petitioner no.6 Shashi Singh caused injury at the head of the brother of the informant through lathi. Thereafter, the petitioner no.2 Vinod Singh, Rajesh Kumar and the petitioner no.3 Pappu Singh gave direction to the informant to pay Rs.50,000/- as ransom, if he wants to live alive.
Learned counsel appearing on behalf of the petitioners submits that, in fact, the land, as detailed in the F.I.R., was jointly purchased by the petitioners' and the informant's sides and due to partition of the land, some dispute arose in between the parties regarding which Title Suit No.154 of 2011 was filed , which is pending in the court of the Sub Judge-I, Jehanabad. Moreover, the injuries, as found on the person of the informant, are simple in nature.
Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the
