The Petitioners apprehend their arrest in Laheriasarai P.S. Case No.353 of 2016 instituted for the offence under Section(s) 363, 366-A/34 Indian Penal Code. It is alleged that the Informant learnt on 24.07.2016 that his daughter, Sonawar Praveen, aged about 13-14 years is missing. During search, on 25.07.2016, the Informant came to know that his daughter was last seen with Amlesh Kumar Ram, who was Compounder in RSM Hospital. They were on talking terms and quite friendly with each other. The Informant has alleged that his daughter has been kidnapped by Amlesh Kumar Ram and she has taken jewellery with her.

Patna High Court Cr.Misc. No.54669 of 2016 (3) dt.28-01-2017 2/3 The victim girl in her statement recorded under Section 164 Cr. P. C., which is mentioned in para 115 of the Case Diary, has stated that when she had gone for morning walk four persons kidnapped her in which she identified Amlesh Kumar Ram. Later on, she knew the name of other persons. The learned APP has read out the statement of the girl recorded under Section164 Cr.P.C. From her statement, it appears that she knew only Amlesh Kumar Ram and she also got married with him.

It has been submitted on behalf of the petitioners by filing Supplementary Affidavit that the girl has, now, married with Amlesh Kumar Ram and Affidavits have been sworn by the victim girl and Amlesh Kumar Ram, which are annexed as Annexure-2 series of the Supplementary Affidavit. Be that as it may, from the written report and the statement of the victim recorded under Section 164 Cr. P.C., no specific overt act has been alleged against the petitioners. In the circumstances, prayer of the petitioners for anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Laherisasarai P.S. Case No.353 of 2016, they shall be released on anticipatory bail on furnishing bail bond of
