The petitioner apprehends his arrest in connection with Laukahi P.S. Case No. 186 of 2018 (G.R. No. 1402 of 2018), registered under Sections 341/323/354(b)/504/506/34 of the Indian Penal Code.

The allegation against the petitioner is that petitioner along with one other person tried to outrage the modesty of the informant by pulling her Sari etc. It has further been alleged that when the informant went at the home of the petitioner for making complaint, the petitioner and the other accused persons assaulted the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and both the petitioner and informant

Patna High Court CR. MISC. No.25585 of 2019(3) dt.02-08-2019 2/2 belong to the same village and there is land dispute between them. He further submits that petitioner is young person of 21 years and studying in class 12.

After having heard learned counsel for the parties and taking into consideration the fact that the petitioner is student of class 12 and both the parties belong to the same village, I am inclined to grant anticipatory bail to the petitioner. This application is, accordingly, allowed.

Let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of four weeks from today, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Jhanjharpur (Madhubani) in connection with Laukahi P.S. Case No. 186 of 2018; subject to condition as laid down hereinabove and under Section 438(2) of the Code of Criminal Procedure. (Anil Kumar Sinha, J) S.Katyayan/- U T
