This application arises out of a proceeding under Section 48E of the Bihar Tenancy Act ( for short 'the Act'). The Collector under the Act considered the application filed by the petitioner and rejected the same on its threshold for the reasons stated therein.

The writ application was rejected as against the landholders ( respondent nos. 3 and 4). Subsequently, it was restored. The application was admitted to hearing without any interim order.
