JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-01-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Rajgir P.S. Case No. 81 of 2019(G.R. No.1202 of 2019) for offences under Sections 147, 149, 341, 323, 353, 379, 427 and 504 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent. Learned counsel submits that the allegation against the petitioners is that they have restrained the Executive Magistrate in discharging of his duties. Petitioner no.1 is President of Safai Karmchari Union and the petitioners were protesting against Municipal

Patna High Court CR. MISC. No.28378 of 2020(2) dt.15-01-2021 2/2 Corporation and Nagar Panchayat and as such, they have been made accused.

Considering the aforesaid, this Court is inclined to grant privilege of anticipatory bail to the petitioners. Let petitioners, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 81 of 2019 (G.R. No.1202 of 2019), subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
