JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2016 Heard learned counsels for the petitioner and the State.

The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 323 and 504 of the Indian Penal Code. The prosecution case is that the informant gave Rs.80,000/- to the petitioner for providing employment but neither the employment was provided, nor the money was returned. Subsequently, a cheque was issued which got bounced.

It is submitted by learned senior counsel for the petitioner that the case was registered in 2009 but the investigation has still not concluded. Moreover, the informant has retracted from the initial version and filed a compromise

Patna High Court Cr.Misc. No.1479 of 2016 (2) dt.12-01-2016 2/2 petition before the learned court below stating therein that he received his due amount.

Considering the retracted version of the informant, it is a case for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Ismailpur P.S. Case No.43/2009, pending before the learned Judicial Magistrate, 1st Class, Naugachia, Bhagalpur.

With the above observation, this application is, accordingly, disposed off.
