2. The petitioner seeks regular bail in connection with Makhdumpur P.S. Case No. 584 of 2023 registered for the offence under Sections 302, 201/34 of the Indian Penal Code.

3. As per the prosecution case, the deceased was killed by unknown criminals and subsequently his dead body was recovered. The petitioner and others were suspected of killing the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Petitioner is in custody since 04.07.2025 and has no criminal antecedent. It is further submitted that there is no eye witness of

Patna High Court CR. MISC. No.30143 of 2026(2) dt.08-05-2026 2/3 the alleged occurrence and only on the basis of the suspicion, the petitioner has been implicated in the present case. It is further submitted that similarly situated co-accused persons have been granted bail by this Court vide order dated 09.10.2025 in Cr. Misc. No. 70178 of 2025 and vide order dated 19.03.2026 in Cr. Misc. No. 8158 of 2026.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Having considered the facts and circumstances of the case, the period of custody and the fact that similarly situated co-accused persons have been granted bail by this Court, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Makhdumpur P.S. Case No. 584 of 2023.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case
