JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323, 341, 406 and 420 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The prosecution case is that marriage of the daughter of the informant, namely, Mira Kumari, was fixed with petitioner no. 4, Tribuhvan Rai and, thereafter, the informant paid rupees two lakhs. Subsequently, further demand of gold chain and motorcycle was made by the accused persons and, non fulfillment of the same neither marriage of daughter of the informant was performed nor

It is submitted by learned counsel for the petitioner that there is no proof with regard to the payment made. In fact, the daughter of the informant wants to marry with another person with whom she eloped prior to marry. Subsequently, when daughter of the informant returned, the informant forcibly tried to fix the marriage of his daughter with petitioner no.4. Petitioner no. 4 is the alleged bridegroom whereas petitioner nos. 1, 2 and 3 are the parents, grand parents and brother of petitioner no. 4. Considering the nature of accusation, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional chief Judicial Magistrate, Gopalganj in connection with Mohamadpur P.S. Case No. 45 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
