The petitioners apprehend their arrest in connection with Saraiya P.S. Case No. 433 of 2018 registered under Sections 272, 273 of the Indian Penal Code and 37(d), 30(a), 38, 41 of the Bihar Prohibition and Excise Act, 2016. Learned counsel appearing on behalf of the petitioner submits that petitioners have no criminal antecedent. They have falsely been implicated in this case due to village politics. Further he submits that on perusal of Seizure List, it appears that nothing has been recovered from the possession of the petitioners rather the alleged country liquor has been

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Muzaffarpur in connection with Saraiya P.S. Case No. 433 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
