2. The petitioner is in judicial custody in connection with Paroo P.S. Case No. 145 of 2021 for the offence punishable under Sections 341, 323, 324, 307, 379, 504, 447, 506 and 34 of the Indian Penal Code lodged on 24.4.2021 by the informant, Abdul Sattar.
3. As per the prosecution story, the informant alleged that in the fight between the children, the elders also came and the allegation against the accused persons that they started abusing and upon objection, this petitioner came with a knife and straight away assaulted in the abdomen of the informant's son causing injury, he became unconscious and was immediately rushed to Paroo Hospital and later considering his
Patna High Court CR. MISC. No.31336 of 2024(2) dt.21-06-2024 2/2 serious condition was referred to Muzaffarpur. This followed the FIR.
4. Though learned counsel for the petitioner tried to impress upon this Court that in a smaller dispute, the incident took place, he do not have criminal antecedent.
5. Learned APP points out that in the said minor incident, the allegation is that this petitioner gave knife blow causing serious injury in the abdomen. It has been further pointed out by learned APP that anticipatory bail was rejected on 18.7.2023 but he finally came into judicial custody only on 17.1.2024.
6. In that background, for the present this Court is not inclined to extend him the privilege of bail which is accordingly rejected.
