The petitioner seeks bail in Khutauna P.S. Case No. 142 of 2017, instituted for the offence under Section(s) 394 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of co-accused Suresh Kumar Sonar @ Suresh Sonar who has already been granted bail by coordinate Bench of this Court vide order dated 14.5.2019 passed in Cr. Misc. 24271 of 2019.

Petitioner is in custody since 20.2.2019.

Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Jhanjharpur, Madhubani, in connection with Khutauna P.S. Case No. 142 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
