====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 18-01-2017 Heard learned counsel for the petitioners.
The present application has been filed seeking extension of time granted to the petitioners to surrender for release on bail in terms of the order dated 17.10.2016 passed in Cr. Misc. No. 44093 of 2016.
Learned counsel for the petitioners submitted that the petitioners, being poor persons, had gone out of the State to earn their livelihood and could not be communicated with regard to the order so as to surrender before the Court below within the time granted for doing so. It was submitted that there is no deliberate lapse on the part of the petitioners and once the Court, on merits, has allowed the privilege of pre-arrest bail, the time to
Patna High Court Cr.Misc. No.560 of 2017 (2) dt.18-01-2017 2/2 surrender should be extended as the grounds are bona fide and genuine.
Having regard to the facts and circumstances of the case and submissions of learned counsel for the petitioners, the time granted to the petitioners to surrender before the Court below in terms of the order dated 17.10.2016 passed in Cr. Misc. No. 44093 of 2016 stands extended till 18th February, 2017. The rest of the terms and conditions of the aforesaid order shall remain unchanged.
The application stands disposed off in the aforementioned terms.
