====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-04-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Patliputra P.S. Case No.70 of 2019 registered under Sections 341, 342, 323 and 307/34 of the Indian Penal Code besides Section 27 of the Arms Act.

The accusation is that in the evening of 12.02.2019, the informant along with his bodyguard moved from his hotel for the house with Rs.60,000/- boarding on the vehicle. When he reached near Shiv Temple, then 7 persons, named in the F.I.R., including the petitioner variously armed with deadly weapon, tried to stop the vehicle and when the vehicle was not stopped, then they attacked at the vehicle in which the driver of

Thereafter, the informant was got down from the vehicle and was assaulted by them through hockey, danda and katta and they took the cash bag of the informant and Mahendar Mahto started to flee away taking his cash bag. Anyhow, the informant started to flee away towards police station, then Laxmi Mahto made firing upon him through katta. The bodyguard of the informant also made firing in air. Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner is the uncle of the informant and due to family dispute, the informant has lodged the present case. The alleged occurrence took place in different manner regarding which co-accused Raju Prasad has lodged Patliputra P.S. Case No.

69 of 2019 under Sections 341, 342, 323 and 307/34 of the Indian Penal Code against the informant, his bodyguard and 4-5 others. Only to save his skin, the informant has lodged the present case. Except one case, which has been lodged by the informant, as detailed in paragraph-3 to this application, in which the petitioner is on bail, the petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be

Case No.70 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
