The petitioners apprehend their arrest in Nautan P.S. case No. 65 of 2017 registered under Section 353, 427 and some other Sections of the IPC.
The S.H.O., Nautan P.S alleged that he got information that villagers after putting a dead body of a person on road are raising slogans against the police and administration. When the informant and other police officials went there it transpired that Bhagwan Gond, accused of Nautan P.S. case No. 178 of 2016, died in a motor accident and the villagers, having armed with different weapons, blocked the road.
The learned counsel for the petitioners submits that petitioners were not processionists. The entire villagers have been named in the case.
Considering the facts aforesaid and nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the
Patna High Court CR. MISC. No.30694 of 2019(2) dt.09-05-2019 3/3 satisfaction of learned Additional Chief Judicial Magistrate-XII, Siwan in connection with Nautan P.S. case No. 65 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
