Petitioner is in custody in connection with Wairganj P.S. Case No. 345 of 2016 for the offence under sections 395 and 397 of the Indian Penal Code.

Allegation against this petitioner is that he was involved in loot of jewellery worth Rs. 1.80 lacs and cash of Rs. 3 lacs.

Learned counsel for the petitioner submits that the petitioner is in custody on remand since 20.12.2019. He further submits that in this case the petitioner was remanded after three years of the occurrence.

Learned counsel for the State submits that release of the petitioner may create law and order problem in the ensuing

Patna High Court CR. MISC. No.24868 of 2020(2) dt.28-09-2020 2/2 election.

Considering the aforesaid, the application is disposed of with a direction to the court below to release the petitioner on bail on appropriate terms and conditions after election is over i.e. 11.11.2020.
