Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Nathnagar (Madhusudanpur) P.S. Case No. 764 of 2020 registered for the offence punishable under Section 147, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code and under Section 3, 4 of Explosive Substance Act.

The petitioners are said to have thrown bomb on

Patna High Court CR. MISC. No.37521 of 2021(2) dt.07-04-2022 2/2 the informant.

It has been submitted by learned counsel for the petitioners that the petitioner no.1 is 80 years old and petitioner no.2 is a physically handicapped person and they are not expected to act in such a manner.

Considering the aforesaid, this bail application is allowed on behalf of petitioner nos. 1 and 2, above named. Accordingly, let the petitioner nos. 1 and 2, above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bhagalpur, in connection with Nathnagar (Madhusudanpur) P.S. Case No. 764 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

So far as the bail of petitioner nos. 3 and 4 is concerned, the same is dismissed as they are said to be the active participants in the crime.
