JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-05-2018 The petitioner seeks bail in anticipation of his arrest in connection with Rail Chapra P.S. Case No. 03 of 2018, dated 07.01.2018, instituted initially for the offence punishable under Section 379 of the Indian Penal Code, but later Sections 411 and 414 of the Indian Penal Code have also been added.

The petitioner is not named in the First Information Report. The informant claims to have been robbed of his belongings while traveling in a train. The name of the petitioner transpired in the confession of his

Patna High Court Cr.Misc. No.25183 of 2018 (3) dt.03-05-2018 2/2 brother/Sanjay Kumar Sah, who has stated before the police that he along with the petitioner had purchased stolen goods. Apart from this, the name of the petitioner has also come in the confession of one Mukesh Kumar Singh, but without there being any specific accusation. The petitioner owns a Jwellery shop and has falsely been implicated by the local police for the reasons which are not known to the petitioner. Regard being had to the fact that the name of the petitioner has transpired in the confession of co-accused persons and the petitioner does not have any criminal antecedent, he is directed to be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on his furnishing of bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate (Railway), Sonpur (Saran) in connection with Rail Chapra P.S. Case No. 03 of 2018.
