JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-06-2018 The petitioners seek bail in anticipation of their arrest in connection with G.O. Case No. 311 of 2015 instituted for the offences punishable under Sections 33, 41 and 42 of the Indian Forest Act.

The petitioners are alleged to have snatched fire wood from the informant, a forest official, and also resorted to brickbats.

Mr. Ramadya Singh, learned Advocate for the petitioners has submitted that from the averments made in

Patna High Court Cr.Misc. No.31363 of 2018 (3) dt.29-06-2018 2/2 the F.I.R./prosecution report itself it would appear that a false case has been instituted against them. It is none of the official duty of the forest officials to carry fire wood. In fact, the petitioners were carrying the fire wood and the forest officials wanted some money for letting them take the fire wood. When that was protested to, the present case has been lodged.

The petitioners were earlier made accused, but the offences for which they were charged were minor in nature.

Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 6th Additional Chief Judicial Magistrate, Nawada in connection with Trial No. 3073 of 2016, arising out of G.O. Case No. 311 of 2015.
