JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-05-2018 The petitioner, who is an 85 years old lady, seeks bail in anticipation of her arrest in connection with Madhepura P.S. Case No. 693 of 2016, dated 11.11.2016, instituted for the offences punishable under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code.

The petitioner and others are said to have fraudulently got a Jamabandi created in their names with respect to Gair Majarua land.

Learned counsel for the petitioner has submitted that the petitioner had, in fact, purchased the property long

No.25184 of 2018 (3) dt.03-05-2018 2/2 time back from the Jamabandi holder and if the land which was transferred in favour of the petitioner was a Gair Majarua land, only the petitioner has been cheated and nobody else. The allegations in the First Information Report are absolutely vague and general in nature. It has further been submitted that the accusation borders primarily on civil dispute. Regard being had to the age of the petitioner and nature of the accusation, the petitioner, above named, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, is directed to be released on bail on her furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 693 of 2016.
