JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-01-2016 Petitioner is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 406, 420 of the Indian Penal Code.
The prosecution case is that the complainant paid Rs. 83,000/- to the petitioner and co-accused Madan Gupta for providing employment abroad but subsequently forged VISA and tickets were given. On demand being made, the money was not returned.
It is submitted by learned counsel for the petitioner that there is no proof with regard to payment. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today,
Patna High Court Cr.Misc. No.1333 of 2016 (2) dt.11-01-2016 2/2 be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Complaint Case No. 1336 of 2015, Trial No. 1752 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
