JUSTICE SATYAVRAT VERMA ORAL ORDER 10-12-2021 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in connection Excise Case no. 149 of 2021 registered for the offence punishable under section 30(a) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 19.3.2021 and is person with clean antecedent and charge sheet has been submitted. Allegation is that he was found delivering one bottle of foreign liquor and at

Patna High Court CR. MISC. No.37733 of 2021(2) dt.10-12-2021 2/2 his instance 28.350 liter of liquor was recovered from Kiose concealed in a plastic bag. Learned counsel submits that petitioner has no concern with alleged recovered liquor and he was falsely implicated in the present case.

Learned APP opposes the prayer for bail.

Considering the facts that petitioner is in jail custody since 19.3.2021 and is person with clean antecedent and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Muzaffarpur in Excise Case no. 149 of 2021.
