Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Kishanganj P.S. Case No. 103 of 2023 registered for the offence under Sections 30(a), 32, 41, 47 of the Bihar Prohibition and Excise Act, and Section 30 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 12.03.2023 and there is recovery of 106.2 litres of Indian made foreign liquor from his possession and he has two criminal antecedents.

Learned APP has vehemently opposed the prayer of bail.

Considering the period of custody and recovery of

Patna High Court CR. MISC. No.28177 of 2023(2) dt.15-05-2023 2/2 liquor from his possession, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge-II-cum- Special Judge (Excise)-1, Kishanganj in connection with Kishanganj P.S. Case No. 103 of 2023.
